Unless they’re holding your records for an unpaid balance, they should provide you a copy of all records in their possession.
He can’t even hold them for an unpaid balance. His own, he can, but not ones from another dentist that you brought to him.
Is there any way that you can get copies from the original dentist? That may be the best way to go. Or you could write a nice letter requesting your records stating that if he does not release them you will file a grievance with the State Board (if in the states).
I personally do not understand offices that refuse to release x-rays or records to patients or other dentists. We always release them at the patient’s or other dentist’s request. Aside from the fact that patients have a legal right to them, it is just common courtesy.
