Yes, Medicare is specifically prohibited from negotiating for the best prices because of the volume of people who are covered. The result of this lack of negotiating is that the cost of prescription drugs purchased under Medicare are 40 percent higher than the costs that the Veterans Administration incurs. Why is this? Because the VA can negotiate for the best deal for their patients and Medicare cannot.
The only small change that the Affordable Care Act provided was that there is a 50% discount on drugs purchased in the “donut hole,” the gap between coverage in Medicare.
Note that the initial House-passed health care bill would have required the secretary of Health and Human Services to negotiate drug prices directly with pharmaceutical manufacturers for Medicare Part D plans starting in 2011. That never made it to the final bill.
